ICJ climate opinion may raise directors' duty of care, Australian legal report says

( April 20, 2026, 04:37 GMT | Official Statement) -- MLex Summary: A legal opinion authored by Australia’s incoming Solicitor General Ruth Higgins and published Monday says an International Court of Justice advisory opinion on climate change is likely to influence directors’ duties by increasing exposure to climate-related risks. In the 39-page report, Higgins and two co-authors say the ICJ opinion could lead to the likelihood of more stringent climate regulations in Australia and an increase in litigation against emissions-intensive industries. To minimize the risk of litigation, the report advised directors to stay well-informed about the corporation’s climate-related risks and to ensure those risks are accurately disclosed in public statements. Report attached....
