Romania's creation of monopoly for ship services may be state aid, EU court says

( March 26, 2026, 11:58 GMT | Official Statement) -- MLex Summary: A Romanian law granting the rights to services guiding ships in and out of ports exclusively to public authorities could potentially amount to state aid, an opinion prepared for the EU’s top court has said. Pilotage services are an “economic activity” and so the port authorities entrusted with them should be viewed as “undertakings” under EU state aid law, Advocate General Andrea Biondi said in his opinion for the Court of Justice. To check whether competition was distorted, he said national judges must assess whether the Romanian law creating a state monopoly — on grounds of safety, security and environmental protection — was justified.The Advocate General opinion is attached (in French)....
