Quince accuses Deckers of using hundreds of sham trade dress lawsuits as an exclusionary weapon to block competitors and maintain its dominance in the US market for sheepskin- and shearling-lined casual footwear. In its motion to dismiss, Deckers argued that Quince’s complaint "must be dismissed because the conduct of which Quince complains — that Deckers sought to protect its intellectual property rights by petitioning courts for redress from infringers’ conduct — constitutes protected activity under the First Amendment and the Noerr-Pennington doctrine."See attached motion....
