Most of California’s age-appropriate design law can go forward, US appeals court rules

( March 12, 2026, 16:16 GMT | Official Statement) -- MLex Summary: Most of a California law that imposes restrictions on companies to protect children online can go into effect, according to a ruling by a three-judge panel on the US Court of Appeals for the Ninth Circuit in a case brought by NetChoice. The panel did affirm an injunction with respect to the law’s data use and dark patterns restrictions on vagueness grounds because the challenged provisions do not clearly delineate the proscribed conduct. However, the panel vacated the district court’s order insofar as it enjoined the law’s valid remainder on severability grounds because, at the current stage of the litigation, it could not determine whether the notice-and-cure provision is severable from the law’s remaining provisions. The panel also found that NetChoice is not likely to succeed on the merits of its facial challenge to the law’s age estimation requirement or its coverage definition.See attached file. ...
