ECJ, national authority's decisions don't change EU law, top court rules

( March 12, 2026, 09:18 GMT | Official Statement) -- MLex Summary: A national authority’s decision, an EU top court's preliminary ruling and guidelines from a regulatory body don't change EU or national law, the EU’s top court ruled Thursday. After an EU court judgment declared "zero tariff" clauses in internet contracts against Union law in 2020 and 2021, providers needed to modify contracts, Hungary's media regulator said. Hungarian judges had asked whether the decision amounted to changes in the law and, thus, an activation of an exemption in the European Electronic Communications Code. Judges confirmed, the exemption didn't apply, thus allowing users to end internet contracts without further costs. Press release and judgment attached.
