US government demand for location history a 'search' under Fourth Amendment, CCIA, SIIA says

( March 9, 2026, 21:09 GMT | Official Statement) -- MLex Summary: The Software & Information Industry Association and Computer & Communications Industry Association told the US Supreme Court that a governmental demand for location history is unquestionably a “search” within the meaning of the Fourth Amendment because it reveals data in which individuals have a reasonable expectation of privacy. Also, because it is a search, the Fourth Amendment’s protections and requirements apply with full force at each step to every search. They also said that the Stored Communications Act independently requires a warrant, because location history data constitutes “contents” of electronic communications. See attached brief....
