Hospitals' US antitrust claims against CVS dismissed with prejudice

( March 3, 2026, 23:00 GMT | Official Statement) -- MLex Summary: A federal court dismissed with prejudice Brandywine Hospital and Reading Hospital's amended US antitrust claims against CVS Health Corporation after finding the plaintiffs failed to state a claim for illegal tying and that the court itself lacks personal jurisdiction over CVS Health. Low-income patients may choose to contract with CVS pharmacies or "any and all pharmacies they choose" to obtain 340B savings, and if CVS's requirement that those patients use its Wellpartner third-party administrator is supposedly burdensome, the plaintiffs "may still contract with a different pharmacy to obtain 340B Savings from other patients," said the order, filed in the Eastern District of Pennsylvania. The fact that plaintiffs cannot steer their patients to their own pharmacies as opposed to CVS's "does not save their claims," and CVS has unquestionable power over the price and conditions it places on contracting with low-income patients that does not constitute an illegal monopoly, the order said.See attached document....
