US DOJ files statement of interest in frozen potato price-fixing case

( February 27, 2026, 16:42 GMT | Official Statement) -- MLex Summary: JR Simplot, Lamb Weston, McCain Foods, and other defendants in multidistrict price-fixing litigation are "urging narrow and incorrect rules of law" regarding the primary elements of a claim under Section 1 of the Sherman Act, the US Department of Justice said in a statement of interest filed in the US Northern District of Illinois. Motions-to-dismiss filed by the companies "are incorrect" to the extent they argue reciprocal information sharing allegations are insufficient to meet concerted action requirements and that sharing backward-looking, aggregated data cannot generate anticompetitive effects, the statement said.See attached document....
