Belgian questions on GDPR compliance over bank data transfers to US published by ECJ

( February 26, 2026, 17:45 GMT | Official Statement) -- MLex Summary: Belgium’s Market Court has asked the EU Court of Justice whether the EU-US Foreign Account Tax Compliance Act, or FATCA, agreement — which mandates the automatic transfer of US citizens’ financial data from Belgium to US tax authorities — complies with the EU Charter of Fundamental Rights and Article 96 of the General Data Protection Regulation. Under Article 96, international agreements that existed before the GDPR’s implementation may remain in force, provided that they comply with the EU law applicable when they were concluded. The Belgian court referred 13 questions, some of which concern whether the FATCA agreement complied with EU data protection law as it stood before May 24, 2016, a condition for relying on Article 96.The questions are attached....
