Meta loses US summary judgment ruling in Messenger and Messenger Kids case

( February 20, 2026, 20:25 GMT | Official Statement) -- MLex Summary: A federal judge in Illinois denied Meta Platforms' motion for summary judgment, saying in a case involving Messenger's collection of biometric data that California's privacy law does not trump the Illinois Biometric Information Privacy Act (BIPA). US District Judge Nancy Rosenstengel found that "all roads lead to the impact that enforcement of the choice of law provision would have here: the negation of a critical statutory privacy right belonging to Illinois citizens and the concomitant denigration of the 'public interest.' Thus, the Court finds that enforcing the choice of law provision in the Terms of Service would violate a fundamental public policy of Illinois."See attached document....
