OpenAI discussions about deleting pirated books deemed privileged by US judge

( February 6, 2026, 23:31 GMT | Official Statement) -- MLex Summary: US District Judge Sidney Stein reversed a discovery order in authors' copyright litigation against OpenAI in New York, finding that OpenAI did not waive attorney-client privilege over discussions of deleting pirated books used in AI training. "Simply put, OpenAI did not disclose material protected by the attorney-client privilege," Stein wrote. "In addition, OpenAI did not change its position regarding whether legal advice concerning the deletion of the Booksl and Books2 datasets is privileged, so waiver is not an appropriate sanction on the theory that OpenAI made a 'moving target' of its privilege assertions."See file attached. ...
