Meliá Hotels loses evidence disclosure dispute in damages claim at EU top court

( January 29, 2026, 09:51 GMT | Official Statement) -- MLex Summary: Meliá Hotels has lost an evidence disclosure dispute related to a possible cartel damages claim by Portuguese consumer protection association, Ius Omnibus. The EU's highest court ruled on Thursday that the association must further show that it has a plausible claim for compensation, although that does not need to be "more likely than not." The ruling comes in response to questions referred by the Portuguese Supreme Court which is seeking guidance on whether a claimant needs to show the “plausibility” of its claim to gain access to facts and evidence from the defendant.The Court decision, in French, is attached.
