Ampol Retail-EG deal referred to Phase 2 review under Australia's new merger regime

( January 21, 2026, 00:10 GMT | Official Statement) -- MLex Summary: Ampol Retail's move to acquire retail sites operated by EG Australia has become the first deal to be referred to a Phase 2 review under Australia’s new mandatory merger regime, the competition regulator said. In a statement on Wednesday, the Australian Competition & Consumer Commission said it is satisfied that the acquisition could substantially lessen competition in the retail supply of gasoline and diesel in several markets because the deal would combine two major fuel retailers in Australia. The regulator said it has identified 115 EG sites where the deal could substantially lessen competition in the relevant local market. The watchdog said Ampol’s offer to divest 19 retail fuel sites does not adequately address the issues, which is why it has decided to conduct a further in-depth competition assessment in Phase 2.Statement follows.
