Australian antitrust regulator provides clarity on merger notification waivers

( January 20, 2026, 07:11 GMT | Official Statement) -- MLex Summary: Businesses should lodge a notification for deals involving organizations with combined market shares above 5 percent in the relevant market, the Australian competition regulator said. In an updated frequently asked questions document published on Tuesday, the Australian Competition & Consumer Commission said that such deals may not qualify for a notification waiver, as they are likely to raise issues that need to be explored further. The regulator also said that parties that file a waiver application should not expect to be contacted until the waiver determination is made.The FAQ document is attached....
