Judge partially stays, orders briefing in former US STB member's suit over firing

Friedrich has stayed a count alleging that the firing of former Surface Transportation Board member Robert Primus violated a government statue until after the Supreme Court issues a decision in Trump v. Slaughter. Friedrich also ordered a briefing schedule on the government's forthcoming motion to dismiss the second count, which alleges his firing was racially discriminatory and a violation of the Fifth Amendment. The motion to dismiss is due by Jan. 28, any opposition is due by Feb. 18, and any reply to the opposition should be filed by March 4, according to the order.Docket entry follows below:...
