Seagate gets US antitrust claims against NHK revived on appeal

( January 8, 2026, 17:21 GMT | Official Statement) -- MLex Summary: Seagate Technology alleged a viable theory of extraterritorial reach under the Foreign Trade Antitrust Improvements Act, which allows it to bring US price-fixing claims against NHK Springs over suspension assemblies even though Seagate’s foreign entities were the ones to overpay, according to an appeals court. The Court of Appeals for the Ninth Circuit concluded that Seagate sufficiently alleged that NHK’s conduct in the US led to the domestic harm of higher prices in the US, and that effect also directly caused an antitrust injury abroad because Seagate’s foreign entities overpaid for the suspension assemblies based on the inflated US price.See attached file. ...
