State AGs support reviving US antitrust case against rail freight companies

They argued that the lower court inappropriately adopted a heightened standard. “This court should clarify that plaintiffs need not show unusual pricing decisions so long as other plus factors have been satisfactorily shown and that the appropriate analysis requires a more flexible, sliding-scale approach based on the economic plausibility of the plaintiff’s theory,” they said.
