BdM Banca shouldn’t get compensation for EU recovery order, court opinion says

( December 18, 2025, 10:40 GMT | Official Statement) -- MLex Summary: BdM Banca isn't entitled to receive compensation for the damage it allegedly suffered due to the European Commission's decision for Italy to recoup illegal state aid from Banca Tercas, a legal opinion for the EU's top court suggested on Thursday. BdM Banca, formerly known as Banca Popolare di Bari, is currently challenging the rejection of its claim for compensation by the lower-tier General Court at the EU's highest court. In his non-binding opinion, Advocate General Athanasios Rantos said the plaintiff wasn't able to demonstrate its claim, and recommended upholding the lower court's ruling.The Advocate General opinion is attached.
