Privacy Commissioner of Canada weighs in with Supreme Court over Facebook breach

( December 2, 2025, 23:10 GMT | Official Statement) -- MLex Summary: The Office of the Privacy Commissioner of Canada has filed its detailed arguments in litigation over whether Facebook violated Canada's digital privacy law, the Personal Information Protection and Electronic Documents Act, PIPEDA. The OPC told the Supreme Court that the Federal Court of Appeal correctly ruled that PIPEDA must be "interpreted dynamically" as technology changes, the OPC said. "The FCA’s interpretation of meaningful consent and reasonable safeguards is consistent with PIPEDA’s quasi-constitutional status and Parliament’s intent that the statute be interpreted dynamically in response to technological change. Facebook’s business model requires vast amounts of personal data to drive its targeted advertising; it is not the same as a small business, whose informational needs are both known and limited," the OPC said. See attached document....
