FTC's broad redactions in Pepsi suit can't be justified, US court rules

( December 4, 2025, 22:39 GMT | Official Statement) -- MLex Summary: A New York federal judge ruled that the US Federal Trade Commission's now-withdrawn complaint against PepsiCo is a “judicial document” subject to the common law presumption in favor of public access and to the qualified First Amendment right of public access. US District Judge Jesse Furman granted in part a motion by the Institute for Local Self-Reliance to unseal the FTC’s heavily redacted complaint. Furman said none of the justifications offered by Pepsi or its amicus sufficiently outweigh these presumptions to warrant maintaining the current redactions in full. "The competitively sensitive nature of certain information justifies narrower redactions to the Complaint," the judge said. The court approved narrow redactions to specific information concerning Pepsi’s pricing, internal metrics and projections, and marketing strategies.See attached document...
