US FTC endorses proposed amendment to 'end the ABA's monopoly control' in Texas

( December 2, 2025, 21:46 GMT | Official Statement) -- MLex Summary: The US Federal Trade Commission staff endorsed a proposed amendment to the Rules Governing Admission to the Bar of Texas that it says would eliminate the American Bar Association's "authority to dictate the education requirements needed to take the bar exam and practice law" in the state. In a letter to the Texas Supreme Court, the FTC staff said the current rule "effectively gives the ABA, an organization that has previously flouted the rule of law it purports to promote, the ability to exclude market participants who would compete with its members." They argued that the proposed amendment "would end the ABA’s monopoly control over whether a Texas bar applicant’s legal education is sufficient for admission."Statement follows below.
