Mississippi’s online child-safety law faces high-stakes constitutional test

By Maria Dinzeo ( November 28, 2025, 16:03 GMT | Comment) -- Mississippi is enforcing the toughest online-safety law in the nation, and so far, neither the US Court of Appeals for the Fifth Circuit nor the US Supreme Court has said why they've allowed it to go forward. A forthcoming a hearing on whether HB 1126 can remain in force, which has triggered a wave of amicus briefs challenging its constitutional footing, may clarify whether the law is likely to survive First Amendment review.The US Court of Appeals for the Fifth Circuit gave no explanation for why it allowed Mississippi to impose the toughest restrictions for children’s access to online platforms in the nation back in August. Nor did the US Supreme Court when it upheld that decision, though Justice Brett Kavanaugh said it likely violates the First Amendment (see here)....
