Trump administration further argues US FTC commissioners don't have removal protections

( November 24, 2025, 20:09 GMT | Official Statement) -- MLex Summary: The Trump administration filed a reply in support of the US Supreme Court ruling that the Federal Trade Commission’s statutory removal protections are unconstitutional. The brief argues that Congress cannot convert any executive agency into an independent commission so long as the agency does not exercise preclusive Article II powers. “It would allow Congress to convert the Labor Department into the Labor Commission, even as it would doom removal restrictions for the FTC itself, which exercises foreign-affairs powers plus ‘quintessentially executive’ civil-enforcement powers that are no less preclusive than criminal-prosecution powers,” it said.
