KFTC targets predictability in consent decrees with new opinion, deliberation deadlines

( November 20, 2025, 04:22 GMT | Official Statement) -- MLex Summary: South Korea’s competition regulator has proposed revising its consent-decree rules to speed up settlements by tightening timelines and streamlining procedures. Under the Korea Fair Trade Commission's draft changes, companies would generally have two weeks to comment on examiner reports at both the opening and final-decree stages, down from the four-week and three-week periods that have been applied in full-commission and subcommittee cases. The commission would have 30 days after receiving those submissions to decide whether to open consent proceedings or approve final decrees, and could conduct written deliberations at the applicant’s request. The draft also scraps a duplicative outline step, requires written reasons when consent is refused or not approved. The regulator is accepting public feedback on the draft from Nov. 21 through Dec. 11.The statement, in Korean, is attached....
