( November 18, 2025, 23:00 GMT | Official Statement) -- MLex Summary: Sinclair Broadcasting spoliated evidence through "disorganized, careless, and inadequate" preservation practices and conduct regarding text messages between over 50 of its custodians, and that the affected data is highly significant to plaintiffs' claims that it conspired to fix prices on broadcast television advertisements, an Illinois federal judge ruled. Sinclair failed to take reasonable steps to preserve electronically stored information, to conduct a sufficiently in-depth investigation to identify custodians who had potentially relevant data, or to ensure those custodians fulfilled their obligations to preserve data, US District Judge Virginia Kendall said. However, Kendall denied the plaintiffs' request to present evidence and argument of Sinclair's spoilation at summary judgment and trial; instead monetary sanctions are appropriate and the court directs Sinclair "to make Plaintiffs whole" for the costs of their investigation into the issue, the order said.See attached file....
