Las Vegas hotels oppose appellate rehearing in US price-fixing case

( November 6, 2025, 23:31 GMT | Official Statement) -- MLex Summary: MGM Resorts, Caesars Entertainment, other Las Vegas hotels and Cendyn Group opposed a US appellate rehearing in a price-fixing case, saying the panel’s unanimous decision applying well-settled law to case-specific factual allegations does not warrant rehearing. “Plaintiffs seek this court’s review of only the first independent ground for decision. But the panel got that right. It applied settled precedent holding that, as a threshold matter, an agreement must restrain trade in a relevant market to trigger scrutiny under Section 1. As the panel held, the agreements here flunked that basic test. The software licenses do not require the hotels to do anything—they do not reduce any hotel defendant’s incentive to compete and do not restrain, in any way, hotel defendants’ pricing decisions,” they argued.
