No-poach, wage-fixing bans don't require standalone law: Australian antitrust watchdog

( November 3, 2025, 00:58 GMT | Official Statement) -- MLex Summary: Proposed bans on no-poach agreements and wage-fixing arrangements among employers could be introduced by removing the existing exemptions on employment dealings under Australian competition law, according to the country’s antitrust watchdog. In a submission responding to a government discussion paper on the proposed adoption of a ban, the Australian Competition & Consumer Commission said that while the proposed standalone law would be workable if it mirrored existing provisions of Section 45 of the Competition and Consumer Act, a clearer approach to banning no-poach and wage-fixing agreements would be to simply remove the employment exemptions from the act.  The submission is attached. ...
