American Board of Psychiatry and Neurology wins against US tying case on appeal

( October 29, 2025, 22:31 GMT | Official Statement) -- MLex Summary: While plaintiffs’ complaint shows the American Board of Psychiatry and Neurology has a monopoly over specialty certifications and the maintenance of certification market, their claims fall short of plausibly alleging illegal tying, a US appeals court ruled. In a 2-1 decision, the Court of Appeals for the Seventh Circuit affirmed an order that dismissed claims that ABPN unlawfully ties its maintenance of certification product to initial certification. The court determined that even if the price of other continuing medical certification products were to increase relative to MOC, the investment required to fulfill the MOC program makes it implausible that doctors would shift to purchase MOC.See attached file. ...
