( September 10, 2025, 23:00 GMT | Official Statement) -- MLex Summary: The CarePoint Litigation Trust has appealed what it called the "clearly erroneous" order of a US magistrate judge, which found waiver of any claim of privilege on 150,000 documents as part of its US antitrust case against RWJ Barnabas. "That decision was reached without review of a single document, based on a flawed legal analysis, and made at a hearing at which the Litigation Trust, the undisputed owner of the privilege, was unable to appear," the appeal filed to the District of New Jersey said. A third-party who once had an ownership interest in CarePoint produced the documents to Barnabas in response to a subpoena, and Barnabas capitalized on the "massive production" made by Mandler "to manufacture a privilege waiver argument," the appeal said.See attached file....
