CarePoint trust files reply supporting appeal in RWJ Barnabas antitrust case
( October 20, 2025, 23:00 GMT | Official Statement) -- MLex Summary: The CarePoint Litigation Trust filed a reply in support of its appeal of a US magistrate judge's order that found waiver of any claim of privilege as to 150,000 documents produced to RWJ Barnabas by a third party with previous ownership stake in CarePoint. "As the Litigation Trust has argued, the June 3rd Order appeared to rest on the legally dubious point that waiver inevitably followed from the fact that Barnabas had already reviewed the contents of privileged documents in the Mandler Production," but governing law already contemplates "situations where litigants learn what is contained in privileged documents, but nonetheless must return them," CarePoint said in its reply filed to the District of New Jersey.See attached file....
