RWJ Barnabas opposes CarePoint trust appeal of privilege order in US antitrust case

"Judge Waldor found that CarePoint had already waived privilege over the Mandler documents in multiple ways: by failing to secure Mandler’s files when he departed, by authorizing Barnabas to review and rely on the Mandler production, and by disregarding its obligations under the Confidentiality Order," Barnabas's opposition to CarePoint's appeal said. The idea that CarePoint had no opportunity to be heard on the privilege dispute is refuted by the record, which shows CarePoint did not take advantage of opportunities to protect its privilege, it said.See attached file....
