The Sixth Circuit’s recent decision in Academy of Allergy & Asthma in Primary Care v. Amerigroup Tennessee confirms that US Supreme Court precedent under Illinois Brick bars “indirect” claims regardless of whether harm flows “upstream” or “downstream” along a supply chain, the companies said in a notice of supplemental authority filed in the US District of Minnesota.See attached document....
