OpenAI freed from US chat-preservation order in discovery deal with news outlets

( October 9, 2025, 16:43 GMT | Official Statement) -- MLex summary: OpenAI doesn't need to broadly preserve ChatGPT conversations marked for deletion from Sept. 26 onward under a stipulation between the company and US news outlets including the New York Times. However, OpenAI will continue to preserve data held prior to that date, as long as it did not come from the European Economic Area, Switzerland or the UK. The company will also continue to preserve outputs generated by certain agreed-upon accounts. US Magistrate Ona T. Wang had instituted the preservation order in May, in an effort to understand whether deleted chats include disproportionate evidence of copyright infringement by ChatGPT users. See file attached. ...
