Lufthansa should lose appeal to annulled €6bn Covid-19 bailout, legal opinion says

( October 16, 2025, 09:07 GMT | Official Statement) -- MLex Summary: Deutsche Lufthansa should lose its appeal of an earlier EU court ruling that Germany's €6 billion Covid-19 recapitalization plan for the air carrier was illegal, a legal opinion issued Thursday says. In 2023, the bloc's first-tier court said the EU Commission was wrong to find that Lufthansa couldn't finance itself from the market and that conditions imposed when clearing the support were not enough to safeguard competition. In a non-binding opinion for the EU's top court, Advocate General Andrea Biondi recommended that the challenge be fully rejected, saying that the "context in which the notified aid measure is taken cannot allow the EU institutions to meet a lower standard of reasoning than is required under Article 296 [of the Treaty on the Functioning of the European Union]."The Advocate General opinion is attached.
