Plaintiffs seek rehearing in US appeal of antitrust case against Las Vegas hotels, Cendyn

They said that for more than a hundred years, courts have recognized that written contractual agreements are analyzed under the rule of reason. “The panel defied this precedent and created a new exception to this rule for certain categories of contracts: privileging supply-chain labels over market effects, the opinion forecloses rule-of-reason analysis based on who the parties are, not what the restraint does.”See attached file. ...
