ActiveProspect, Prudential ask US court to affirm judgment against privacy case

( September 29, 2025, 17:44 GMT | Official Statement) -- MLex Summary: ActiveProspect, Prudential Financial and Assurance IQ asked a US appeals court to affirm a judgment against California users’ state privacy law claims over the alleged recording of keystrokes, mouse clicks and other electronic communications. “The district court was right that ‘reading’ or ‘attempting to read’ means comprehending or trying to comprehend what the communication says. Following extensive discovery, the undisputed evidence showed that defendant ActiveProspect (alleged to have directly violated the statute) did not read or attempt to read the contents of any of plaintiffs’ communications while they were ‘in transit’ — or, indeed, ever,” they said.
