Health plans request reconsideration of US price-fixing claims over insulin

( September 29, 2025, 22:32 GMT | Official Statement) -- MLex Summary: Health plans asked a federal judge to reverse dismissal of their US price-fixing claims against pharmacy benefit managers over insulin, saying that the US District Court erred by determining they were indirect purchasers, rather than direct purchasers of the at-issue drugs from the PBMs. The health plans are the only true direct purchasers of the PBMs, meaning only they have paid alleged overcharges and only they can hold the PBMs accountable, the motion for reconsideration filed to the District of New Jersey said. "Because health plans are the only plaintiffs to directly pay the PBMs — and thus the only plaintiff with a claim against them — this Court's ruling would grant PBMs immunity from RICO and antitrust liability and effectively license them to inflate drug prices with impunity under federal RICO and antitrust laws," the filing said.See attached document: ...
