US government moves for judgment against DOGE data-collection case

( September 26, 2025, 16:16 GMT | Official Statement) -- MLex Summary: The US government told a federal judge that federal workers' unions and nonprofits can’t bring claims under the Administrative Procedure Act over data-collection activities by the Department of Governmental Efficiency. “The record does not contain evidence of the necessary ‘final agency action’ for purposes of initiating APA review. The provision of access is neither the sort of action the APA contemplates challenging, nor does it generate, on its own, the sort of consequences characteristic of a final agency action,” it said in a cross-motion for judgment.
