Sovereign functions take precedence over India's competition law, tribunal rules

The tribunal on Tuesday upheld a Competition Commission of India ruling and dismissed an appeal by the Beach Mineral Producers Association against the Directorate General of Foreign Trade and the state-owned Indian Rare Earths for alleged abuse of dominance. The Indian government's policy on atomic minerals cannot be challenged under competition law, a domestic tribunal said, upholding a decision made by the antitrust watchdog....
