Australian antitrust regulator gives details on land leases, revenue tests
( September 22, 2025, 02:01 GMT | Official Statement) -- MLex Summary: The Australian competition watchdog has published an updated "Frequently Asked Questions" document with additional details on land acquisitions and the “combined acquirer or target revenue test” and the “very large corporate group revenue test” under the final thresholds. In an updated FAQs document, the Australian Competition & Consumer Commission said that when applying the revenue tests, businesses must count the Australian revenue of all connected entities of the acquiring party as at the contract date for the acquisition. The regulator also clarified that the acquisition of an “equitable interest which results from an agreement for lease is ‘put into effect’ when the agreement for lease is executed and… becomes unconditional.”The updated FAQs document is attached....
