USPTO places newfound emphasis on prior challenges to patent validity

By Melissa Ritti ( September 17, 2025, 15:34 GMT | Insight) -- US Patent and Trademark Office Acting Director Coke Morgan Stewart on Tuesday said the Patent Trial and Appeal Board must provide a “more detailed explanation” when it reaches an initial or final decision on validity that differs from that reached by the office, a federal district court or the US International Trade Commission on the same or substantially similar patent claims, hinting at a new level of deference owed to prior proceedings.The US Patent and Trademark Office announced Tuesday that its Patent Trial and Appeal Board will begin providing a “detailed” explanation when reaching a conclusion contrary to that of examiners, prior PTAB panels, US courts or the US International Trade Commission on the validity of patent claims or claims which are “substantially similar.”...
