South Korea's revised privacy decree tightens oversight of foreign service providers

( September 17, 2025, 03:22 GMT | Official Statement) -- MLex Summary: South Korea has approved amendments to the enforcement decree of the Personal Information Protection Act, setting new requirements for foreign service providers to appoint local representatives. Starting Oct. 2, foreign operators must designate as their representative a South Korean subsidiary or domestic entity under their control — defined as at least 30 percent equity or power over board appointments — according to the Personal Information Protection Commission. The revised decree also imposes new supervisory obligations on foreign headquarters and mandates disclosure of representative details in privacy policies. Separately, the scope of “public institutions” has been expanded to include local government-funded entities, which face new deadlines to register personal data files and conduct privacy impact assessments.The statement, in Korean, is attached....
