US DOJ opposes motion to intervene from Native American plaintiffs in tariff lawsuit
( September 11, 2025, 20:36 GMT | Official Statement) -- MLex summary: The US Department of Justice filed its opposition to a motion to intervene from Montana's Blackfeet Nation, which requested to join the case before the US Supreme Court weighing the legality of President Donald Trump's use of emergency powers to impose sweeping global tariffs. The Blackfeet Nation requested to join the Supreme Court case because of overlapping issues with the plaintiffs, but the DOJ opposition motion argued they lacked a novel legal interest and could address their concerns in lower courts. The Blackfeet Nation argues Native American tribes are exempt from tariffs because of the Jay Treaty of 1794 and the Indian Commerce Clause. The tribe's case was sent to the Court of International Trade by a federal district court earlier this year and their move to deny the transfer was rejected by an appeals court.See attached motions....
