US DOJ opposes appellate rehearing on conviction of former Uber security officer

( September 10, 2025, 22:31 GMT | Official Statement) -- MLex Summary: In upholding former Uber security official Joseph Sullivan’s conviction for concealing a 2016 data breach from the US Federal Trade Commission, the Ninth Circuit simply followed the statutory text of the Computer Fraud and Abuse Act, the Department of Justice told the appeals court. “As the panel recognized in rejecting it, Sullivan’s proposed interpretation of the statute (endorsed by amici) would allow a company to retroactively render a completed felony non-criminal whenever it served the company’s interests — an approach with no support in the statute or precedent and one that would encourage extortionate schemes,” it said in opposing a rehearing.See attached file....
