US FTC withdraws defense of noncompete rule in 3-1 vote
( September 5, 2025, 21:20 GMT | Official Statement) -- MLex Summary: The US Federal Trade Commission has dismissed its appeals in court cases that challenged a nationwide ban on noncompete clauses in employee contracts. The FTC has filed to accede to the vacatur of the rule in lawsuits brought by Ryan LLC in the Fifth Circuit and Properties of the Villages in the Eleventh Circuit. The agency voted 3-1 to dismiss the appeal and accede to the vacatur. Rebecca Kelly Slaughter, the lone agency Democrat, issued a dissenting statement. Statement follows....
