Though AGCO is correct that the Commission “erroneously told the Court that, during the FTC’s pre-complaint investigation leading to this litigation, a third party filed a motion in federal court to quash a civil investigative demand,” instead of with the Commission itself, and FTC counsel "deeply regrets" the mistake, AGCO’s arguments in support of reconsideration do not meet the high burden required, the filing to the Northern District of Illinois said.
