AGCO asks for reconsideration and stay of production in US FTC, Deere antitrust case
( August 18, 2025, 12:00 GMT | Official Statement) -- MLex Summary: AGCO Corporation moved for reconsideration and stay of a federal court’s order compelling its production of contested documents AGCO provided to the US Federal Trade Commission during a pre-filing investigation for its antitrust claims against Deere & Company over agricultural equipment repair services. Reconsideration is warranted because the court’s order relies on a factual misstatement, where Hargrove & Associates did not in truth file a motion to quash a civil investigative demand in federal district court, but instead with the FTC itself, where “it was resolved entirely within the FTC’s administrative process without any federal court filing or ruling,” the filing to the Northern District of Illinois said. The error is material because it implies that other recipients of CID’s obtained judicial relief “and that AGCO and the [original equipment manufacturers] should have pursued the same course,” the filing said.See attached document....
