OEMs denied protective order in US FTC antitrust suit against Deere
( August 8, 2025, 17:31 GMT | Official Statement) -- MLex Summary: CNH Industrial, AGCO Corporation and Kubota Tractor Corporation were denied a protective order to prevent the US Federal Trade Commission from producing competitively sensitive investigative material obtained prior to antitrust litigation brought against Deere & Co. in the Northern District of Illinois. "Under the unusual circumstances of this case, the Court denies the OEMs’ motion for a protective order to bar the disclosure of the Confidential Information, including the Contested Documents, obtained by the FTC during its pre-filing investigation to Deere and the MDL Plaintiffs," US District Judge Iain Johnston said in an order. The judge ordered modifications to confidentiality orders in the FTC case and a separate class action suit over similar claims.See attached document....
