OpenAI says Musk associates Zilis, Birchall must produce documents as depositions loom

( September 3, 2025, 21:04 GMT | Official Statement) -- MLex Summary: OpenAI told a judge in California that two close associates of Elon Musk who are important witnesses in the litigation between Musk and OpenAI, Shivon Zillis and Jared Birchall, have not complied with subpoenas seeking access to their electronic communications. While Zitis and Birchall have said they are complying with OpenAI's subpoenas, "their repeated failure to honor commitments — or even provide an honest report on the status of their collections and reviews — says otherwise," OpenAI told a federal judge. Zilis and Birchall acknowledged "there were delays in initially collecting the Birchall texts and Zilis Gmails," it is making progress on the document discovery and the impending depositions of Zilis and Birchall can be rescheduled.See attached document....
