General Dynamics, others argue for dismissal of revived US no-poach claims

( August 25, 2025, 22:31 GMT | Official Statement) -- MLex Summary: General Dynamics, Huntington Ingalls and smaller shipbuilders filed a supplemental brief in support of their motion to dismiss US no-poach claims on remand from the Fourth Circuit. “Plaintiffs’ antitrust suit fails on multiple independent grounds that the Fourth Circuit’s opinion does not decide. […] Plaintiffs do not state a claim under Section 1 of the Sherman Act because they fail to plausibly allege an agreement among defendants or an unreasonable restraint of trade. The only question before the Fourth Circuit was a different one: whether plaintiffs had adequately pleaded fraudulent concealment for purposes of the statute of limitations. The tests for pleading an unlawful conspiracy and pleading fraudulent concealment of that conspiracy are distinct, relying on different facts, standards, and case law,” they argued.
